Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and Koala Apps Ltd. ("Koala Apps", "we", "us" or "our") and govern your use of the Koala Inspector browser extension, our website at koala-apps.io and our related services (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you accept these Terms for that organization and confirm you have authority to do so.

You must be at least 18 years old to use the Service.

2. The Service

The Service provides tools to research and analyze online stores. We may change, suspend or discontinue any part of the Service at any time. Koala Inspector is not affiliated with or endorsed by Shopify Inc.

3. Accounts

You must provide accurate information and keep it up to date. An account is for one person and may not be shared. You are responsible for all activity on your account and must tell us promptly about any unauthorized use.

4. Plans, payments and cancellation

Some features require a paid subscription or the purchase of tokens. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the merchant of record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchases are also subject to Paddle's buyer terms.

Prices are shown at checkout, and applicable taxes are added. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account or by contacting us, and cancellation takes effect at the end of the current billing period. Uninstalling the Extension does not cancel a subscription. We will notify you in advance of any price change to an active subscription.

Refund requests are handled under Paddle's buyer terms and applicable law.

5. Tokens

Some features use tokens. Token allowances and the number of tokens each feature uses are shown in the Service and may change. Tokens have no cash value, cannot be transferred or exchanged, and are non-refundable except where the law requires otherwise.

6. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of anyone's rights;
• access or extract data from the Service by automated means, other than through the features we provide;
• resell, sublicense or redistribute the Service or data obtained from it;
• circumvent usage limits, security features or other restrictions, or create multiple accounts to do so;
• reverse engineer the Service, except where the law allows it;
• interfere with or disrupt the Service or other users.

We may set usage limits and may suspend or terminate accounts, including by automated means, if we reasonably believe these Terms have been breached or the Service is being misused.

7. Third-party services and partner links

The Service may link to or work with third-party websites and services, which are governed by their own terms. The Service includes partner links, some of which are affiliate links from which we may earn a commission. We are not responsible for third-party websites, products or services.

8. Information provided through the Service

Information provided through the Service, including estimates and AI-generated content, is for general informational purposes and may be inaccurate, incomplete or out of date. You are responsible for how you use it.

9. Intellectual property

The Service and its content belong to Koala Apps or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

You keep ownership of content you submit to the Service and grant us a worldwide, non-exclusive license to use it to provide and improve the Service. We may use any feedback you give us without obligation to you.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or where required by law. Sections that by their nature should survive termination will survive it.

11. Disclaimer

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied.

12. Limitation of liability

To the extent permitted by law, Koala Apps will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total liability for all claims relating to the Service is limited to the greater of the amounts you paid us in the 12 months before the claim arose and USD 100. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

To the extent permitted by law, you agree to indemnify Koala Apps against claims, losses and costs arising from your breach of these Terms or your misuse of the Service.

14. Changes to these Terms

We may update these Terms. We will notify you of material changes before they take effect. If you continue to use the Service after they take effect, you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Israel, and the courts of Israel have exclusive jurisdiction over any dispute relating to them. If you are a consumer, you also keep any protection given to you by the mandatory laws of your country of residence.

16. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Service. You may not assign these Terms. We may assign them, including as part of a merger, acquisition or sale of assets. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
